State Laws and Restrictions for Purchasing and Using Pepper Spray

However, it is essential to be aware of and comply with the laws governing pepper spray and other defense sprays in your state. These laws vary widely by state, and as a customer, it is your responsibility to ensure that you are in full compliance with all local, state, and federal regulations when purchasing and using pepper spray.
By purchasing from us, you affirm that you are over 18 years of age and that you understand and will abide by these laws.
States Where Pepper Spray is Restricted
(We cannot ship to these states. If an order is placed, it will be canceled.)
- New York: Residents may only purchase defense sprays from licensed firearms dealers or licensed pharmacists within the state.
- Massachusetts: While it is legal to buy, use, or possess pepper spray, it is illegal to ship human formula pepper spray to an address in Massachusetts. Animal sprays, however, can be legally shipped to the state.
States Where Pepper Spray Has Restrictions
- Alaska: Users must be 21 years old to carry pepper spray on school property, and permission is required.
- Arkansas: Pepper spray and gel canisters must not exceed 150cc (5.07 fluid oz).
- California: Pepper spray canisters must not exceed 2.5 fluid oz.
- Florida: Pepper spray canisters are limited to 2 fluid oz.
- Hawaii: Pepper spray containers mailed to Hawaii must not exceed 0.5 oz.
- Michigan: Pepper spray used for self-defense must not exceed 10% oleoresin capsicum (OC) concentration. Canisters are limited to 35 grams (approximately 1.2 oz).
- Nevada: Canisters must not exceed 2 fluid oz of chemical spray.
- New Jersey: Canisters are restricted to no more than 0.75 oz of chemical spray.
- North Carolina: Pepper spray canisters must not exceed 150cc (5.07 fluid oz).
- South Carolina: Canisters must not exceed 1.69 fluid oz.
- Washington D.C.: Buyers must complete a registration form, which the vendor must submit to the Metropolitan Police Department.
- Wisconsin: Tear gas is prohibited. OC products are limited to a 10% concentration with a total weight of 15-60 grams (approximately 0.5 oz to 2 oz). Products must feature safety mechanisms to prevent accidental discharge, an effective range between 6 to 20 feet, and meet specific labeling and packaging requirements (e.g., must be sold in tamper-proof packages and include the manufacturer’s contact information). Sales to individuals under 18 are prohibited.

Pepper spray is legal in all 50 states, but many states and localities impose restrictions on the size, strength, and usage of these products. It is crucial to check with your local and state authorities for the most current and accurate information before purchasing or using pepper spray.
